The email is almost as old as the Internet. And to date, it has held up well in both the professional and private sectors. In many companies, it has become indispensable as an advertising tool: newsletters are not only relatively inexpensive, but can always encourage customers to buy. But despite the many advantages, there are also some legal aspects to consider. Here you can find out what retailers should pay attention to for successful email marketing.

Why do companies use email marketing?
There are many advantages to email marketing. As already mentioned, newsletters are among the rather inexpensive ways to reach and address customers directly in comparison to other marketing instruments. Depending on the provider and the amount of monthly (or annual) emails, newsletters may cost less than 100 euros (possibly even a few hundred euros) per month.
Just like in online trading itself, customers expect newsletters to be tailored and personalized. And with the help of the current software solutions on the market, this is exactly no problem: Salutations and greetings, pictures, links and entire e-mail modules can ideally be adapted with just a few clicks and adapted to smaller user groups. Legal hurdles I: Unauthorized sending of newsletters and data protection
Despite the great potential of newsletters, online retailers are also not allowed to do what they want in the area of email advertising. On the contrary: Both in accordance with the requirements of the European Union and under German law, entrepreneurs must observe strict regulations when it comes to sending advertising mails.
One of the most important rules is: Anyone who wants to send customers an email for advertising reasons needs the consent of the recipient. In practice, it looks completely different, because the advertising emails are usually sent with the registration of a customer account or from the first order without being asked. This may bring good sales, but is prohibited. Senders should therefore make absolutely sure that both elements make sense both individually and in unity and convey a certain seriousness.
